Part-1: How Ordinary People Could got Elected as MLA or MP ; without political tickets, without money, without media support and without muscle power

This is about two ordinary people, who had no money, no support from any political party, no media support, no muscle powers and yet they won elections with thumping majority of votes.

Their uncle's were not Bob. In other words, they had no privilege of being born in family of politicians.

This is unbelievable. So incredible, that some of you would not like to waste further time on this article. Ultimately, at the end of this article nothing concrete will show up in this article.,so why waste time?- some of you may think like this.

Yes. This First part is about Mahendra Mashru.

If you want to check political career of this ordinary man, you can Google it and go to Facebook to read his career graph and to check it with your critical eyes.

But this article is from eyes of a Poet or a Day Dreaming writer. Poets are not bound in four corners of real facts. They can add imagination to publicly known facts.

We poets and day dreamers write as we feel.

Second Part of this article will be about a Maid Servant who got elected to Parliament of Britain. You will find nothing about her from Google, until I will give you some clues... (In fact I have some memories, I will have to search on Google and other search engines)

Purpose Writing of This Blog Post


The purpose is to attempt to convince you, that even for a simple and ordinary person it is possible to win election without money, without media support and without tickets from political parties.

What I see in Future in India


I think that Political Brands have started losing impact on ground level politics. The people who have firm roots at ground level will win elections. They can always win With or Without any tickets of any political parties.


Here, starts the story of an ordinary man


30 Years ago, I began to here stories about this man.

He was serving in a small local bank in Junagadh.

I was also in Junagadh. I had just joined a District Court Bar and in idle time, we used to gossip and hear stories.

Stories I heard


There was a badly managed Government Hospital.
There was corruption.
Doctors used to ask patients to buy costly medicines from market. Ignorant and Illiterate people from small villages. Their plights were too much.

1) Then one day, this ordinary man took a half hour leave from manager of his employer Bank. After taking leave, he went to government hospital and gave his blood to a poor patient who would have died if no one had come forward to give blood in time.

2) After two days, this ordinary man again went to Manager. And once again he asked for a half -hour leave. There was a call from Hospital. Another poor needed his blood.

3) Then it became a routine. Many people joined him. A Blood Bank come up on a two rupee note book. It contained names of willing blood donors and their telephone numbers and blood groups.

4) Then, when any hospital in city wanted blood for any poor, they used to call this man. A donor with right blood group used to reach this private or public hospital, in twenty minutes.

5) No blood donor ever wished or ever asked for anything in return for his blood.

Then things progressed


1) One day, after his service time at bank was over, instead of going to home, this ordinary man, went to Government Hospital.

He found a pillar in Hospital were he could sit. He put a placard, that those patients who are leaving hospital after being cured, should donate unused medicines. These medicines, thereafter will be given free to needy and poor patient.

2) That first day, he waited at pillar of hospital from 6PM to 11PM. Some people donated him some unused medicines.

3) On second day, few of his friends joined him and began to sit with him near pillar in Hospital. They all sat upto 11.00PM and sometime till next day 6AM.

4) Then words spread. More people joined him. Cupboards came up to keep donated medicines.

5) Then one day, a rich man donated an ambulance to this man for helping poor.

6) Meals, began to come up from rich families, to be served to relatives of patients in hospital.

7) And the span of his activities continued to spread. I cannot recall all.

8) One day Bank Manager called this man in his chamber and said,

"Look Young Man, the people need you more than this bank needs you.... So go and serve people whole day......... Just come at 10AM. Put your signature in attendance register and then go away. Some of us will do your work. You just come to collect your salary and to sign in muster register in Bank."

9) The words of his services spread in area of 500 Kilometers from Junagadh.


Then one day he decided to contest election.


He filed his nomination to contest against heavy weights of Congress, BJP and other strong people.

This man had no money to run election campaign. But he knew these:

(1) He had donated his blood to both Hindu and Muslim poor, without asking them about their caste.

(2) Before helping anyone, he never asked any one to bring proof of his poverty.

(3) He never asked or even wished in his mind, for anything in return for his services.

Then he also knew that because of his selfless service, now he had got at least 12 friends who were ready to give  their lives for him. (This is the true index of Leadership Q.   Think if you have any such friends!

He won the election with thumping majority !!


No one knows whether there was any campaign for this man or not. His 12 devotees worked day and night and visited and knocked at doors of voters.

They just told them, "If any time if any of your relative is in hospital, and if he needs blood urgently, and if you will knock at door of this man at 2.00.AM, he will just wear his slippers and will come with you and will give his blood for your relative,and that too, without asking you even your name!"

Well, that was it. He continues to win election after elections, TILL NOW .....

It appears that his Face book account is opened only few months back.

It means he kept winning all these elections, all these years, even without help of Social Media.

Our Duty to this Man


Krishna said in GITA,

"Mankind should sponsor those who are Glorious and Strong among them. In return, They will become pleased, and then They will lead the whole Mankind to that which ultimate good for mankind.


Thus, you should sponsor Glorious and Strong Persons,  and Glorious and Strong Persons will sponsor you. 


By mutually sponsoring each other, the whole mankind should flourish on this planet,"

So as per GITA, our duty is to find out people like this man,and to sponsor them.

My Soul Searching about Blogging and Tweeting with a Supreme Court Lawyer

Just now, sat with an advocate friend Mr.M.N.Tandon, in Supreme Court about my blog writing.

He says our Freedom Struggle is still going on. People are still in bondage. If you think that even one person in world is reading your blog, then you must continue to write. You should not bother even if nor reply comes.

But you must search your soul. If you are getting any benefit from twitter and blog writing, then you must tell people about it.

If you really find after soul searching, that you are not getting any benefit, then keep going on tweeting and blog writing.

He also said, that so much dirt has spread in the world that, if you will try to remove dirt, you will be opposed. Then you will have to be bold and face it.

Lawyers Should Be Bold


May be, it was around 1944.

The place was Bombay High Court.

There was a special parking place for Chief Justice of Bombay High Court. The car parking was reserved from Chief Justice.

One day a lawyer named K.L.Gauba, came early and parked his car at the very parking place which was reserved for Chief Justice.

He refused to move his car when Chief Justice's Car came. 

He said show me the Rules that this place was reserved for Chief Justice.

There were no such Rules till that day.

His car stayed on the ground.

That day, the committee of Judges sat and framed rules for Judges' Parking Place at High Court.

Consider, boldness and clearness of the Lawyer. 

This is Called Rule of Law. 

You should ask to see rules whenever, some one asks you to do something by force.

The only force YOU ARE BOUND TO OBEY is Rule of Law.

Is Something Wrong if Supreme Court Advocates write blogs and tweet on twitter?

I find very few Supreme Court Advocates on blogs and twitter.

Some of them do have professionally designed website. But here the aim is to build up a professional image for professional purpose. They tweet also. 

But very few use blogs and tweets to express against the weaknesses of Judicial System and Plight of litigants.

I am doing this since one month, but I do feel insecure. 

Because I would not like to do anything which is against the conservative views of Judicial System.

WHAT ARE THESE CONSERVATIVE VIEWS

They are as under, as per my view.

1) We judiciary and Bar, represent a disciplined class. We have certain disciplines to observe.

2) People respect our words. We should not say anything in social forums which may decrease people's respect towards us.


I AGREE.

There are many such taboos which put hesitations in minds of good advocates to write blogs and tweets.


BUT HOW CAN WE HIDE THESE FROM PUBLIC ?

1) Landlords do not like to give their house on rent to lawyers.

2) When people enter in District Courts, they do not find seats to sit.

3) Many of these litigants feel that while they are waiting for turns of their case in courts,  they feel as if they are being treated likes those black slaves of South Africa, as portrayed by Gandhiji in his autobiography.

3) Day by day, respect of people towards courts and lawyers in India, is decreasing due to unmanageable arrears of pending cases and because of many other misunderstanding about the system.

To clear these misconceptions of people, shouldn't some advocates come forward to write on blogs and to tweet on twitter?

Please give me you views. 

I do not want to look like an odd lawyer, going against the acceptable norms of colleagues.

This article is in defense of every political leader of country who has been mercilessly condemned by media and people

Lawyers have a special quality.

They can argue for any side. Truth is on side of people for whom they are arguing.... according to them.

It is the Judge who has to decide where the Truth, is after hearing lawyers, and arguments of both sides.

Somebody told me a few days ago, that we should not forget what Sonia Gandhi, Dr. Manmohan Singh, Kapil Sibal, P C. Chidambaram  etc. have done good for the country !

I was shocked to hear this.

Everyday, newspapers, TV are full of one scam of UPA, followed by another scam. There is no halt.

Skeletons  are coming out from cupboards of every political leaders.

In Karnataka and Gujarat also, no peace for leaders of BJP. They are also branded as villains without any trial.

So called leaks and exclusive reports are coming out every minute.

The political class can't even see some porn in their mobiles just to relax their minds!

These are very pitiable tragic days for them.

HOW DO I ARGUE MY CASES IN COURT

First, I accept all allegations made against my client.

So here, let us assume that all allegations of Black Money are true. All allegations in Coalgate  scam are true.
Let us assume that all allegations in 2G Scams are true and all are involved.

Let us also assume that all allegations against Modi and other BJP leaders are also true.

BUT THIS DOES NOT PREVENT ME TO ARGUE THAT

1) THESE ALL ARE GOOD PEOPLE;

2) AND THEY HAVE MADE VALUABLE CONTRIBUTIONS TO NATION

3) AND WE NEED THEM TO CONTINUE TO WORK FOR STRENGTHENING OUR COUNTRY          

4) PARTICULARLY AGAINST A SILENT, SYSTEMATIC AND INVISIBLE INVASION OF OUR  COUNTRY BY FOREIGNERS.

THIS INVASION IS RIGHT NOW IN PROGRESS,WHEN YOU MAY BE READING THIS POST;


THINK ABOUT A MAN STANDING ON A SEA SHORE;


                 Let us go away from this arguments, to a sea shore, where a man is standing and watching at the waves of sea.

                 He is also thinking. He has been told that right below this sea shore, 12 miles deep in sea. A mine of Gold has been found.  Probably, 1,00,000,00 tons of Gold is waiting to be unearthed.

                 Then, he wonders, how much money will be needed to set up a plant for digging gold from below sea bed. Probably, 1,00,000,00 Crores Ruppees.He estimates.

                 Then, he thinks how much men will be needed at plant. Probably these will give employment to 10,00,000 people for digging and distributing and exporting gold.

                 He returns to his hotel. On his way, he buys one dozen apples. He shuts himself in his room with a pencil and few papers and one dozen apples.

                 Next day morning flight, he leaves the village.

AFTER FIVE YEARS.

                 The village has now become a city. There are 1,00,000 people working in Gold-Digging Comapny set up at sea shore. There is prosperity in town. Earlier, villagers had to go to big cities for searching livelihood. Now everyone here is earning and every one is using Iphone and Ipad to tweet across world.

                  So far everything is fine. Everyone in town is happy.

                  No one knows about the man who came here five years ago to survey the sea shore and to buy   one dozen apples.


THEN THE HELL IS BROKE OUT

                 A TV News Channel, produced an exclusive report on how many crores of bribe changed hands in setting up this Gold-Digging Project. The news channel crys foul. Tweets start rolling out on internet about how corrupt the Inida is!

                 A no-nonsense man goes to a lawyer. Lawyer files a PIL in Court. The corrupt people starts going to jails. The Gold Digging Company finds that it is running into loss of crores of rupees. It starts considering closing down the company. The employees of company no more look so happy. They have started fearing unemployment.

AND WHERE IS THE MAN WHO PURCHASED ONE DOZEN APPLE AND MADE THIS COMPANY HAPPEN?

                 He is unmindful of what is going in TV and Newspapers and Courts. He is not involved anywhere. He had just bought one dozen apple five years ago from this village.

                 He is now standing at sea shore of some other country. He is surveying, wealth lying underneath sea water of that country. He again buys one dozen apples from that village and goes to his hotel room with pencil and some papers.

                After five years, a new company will come up in that village in that country.

                This time this man does not want to buy one dozen apple from any village in India in future. He dislikes apples of India very much.

THE CONCLUSION:

All these political leaders, are basically, "People Who Make Things Happen."

They operate at a higher level of intelligence.

All of them whether, UPA or NDA, have made good things also happen for the country. They are basically good people at heart.

If UPA people have given us RTI Act, the BJP people have also shown us a way to communal harmony and all inclusive progress in Gujarat.

Together, they have brought lots of foreign money and industry in India.

Probably, because of policies of these people,  I am now Owner of One IPad and Three Iphones.


AND WHICH IS THIS SILENT, INVISIBLE INVASION OF COUNTRY ABOUT WHICH I SPOKE?

Leading Lawyers have started disappearing from Supreme Court.

When I inquired, I am told that now they are no more practicing as lawyers. They have set up some kind of NGO and lots of money are pouring in from abroad for various social causes.

This is the foreign invasion.

The Countries in world, now no more fight on borders or with air crafts and battle tank.

They start pouring funds in NGO of enemy country.

In return that NGO starts fighting against the Government of that country.

If Government wants peace from these lakhs of NGO sprang up in country, it has to BUY peace from foreign people who may be sending money to this people.

The Government never tells us everything which is going on. So we will never know what is happening.

These are new kinds of economic wars, we seldom understand fully.

Well, here my arguments end.

It is now in Your Lordships to have mercy on my clients.
Let there be some mercy even if they are sent to jails. Kindly do not send them for life imprisonments.
Let them live and do good for the country.

This is only a lightly written article.

Partly provoked by my wife Saroj and partly by some one on twitter, who said that India, very much needs Ayn Rand Philosophy for progress of country.  This article is result of these inputs.

As a lawyer, I do not believe that my client is innocent. It is my duty to argue to the best of my ability. So I have just argued in favor of those who make things happen for our prosperity. Sometimes at the risk of earning huge losses.

I know about a company. It is now saddled with liability to pay Rs.600 Crores, because it refused to bribe few thousands ruppes to a small forest officer. And its project got derailed for six years, just because of a small forest officer.

The People Who Make Things Happen  are different.
They think differently.
                   



Are There some Mantra, affirmations which can help us the moment we speak them?

"Everyday in every way, I am getting better and better."

This is a mantra said to have been coined by a famous psychologist. Thereafter, now it is also widely accepted by many businessmen and self-help gurus.

Lord Krishna, suggested his devotees to repeat Gayatri Mantra.  The exact meaning of Gayatri Mantra is known to almost all Hindus and others. The meaning is too well known to describe here. It is everywhere on internet.

But in my view, the following Mantra is also a good reflection of Gayatri Mantra,

"O Mother, who created this whole Universe, kindly glide me to that which is most beneficial to me and which is also most desired by Gods."

A hundred years old book, "Master Key to Success", prescribes and advises us to keep repeating following Mantra,


"I am whole, perfect, strong, powerful, happy and harmonious."

The book says, by repeating this mantra, we attract certain conditions from Universe, that finally makes us successful.

Gandhiji, probably, daily repeated a Mantra-Song, "Vaishnav Jan To Tene Re Kahi a..."

This mantra probably, imbibed in Gandhiji all good virtues, which we find hard to imbibe in us.

Since ages, people believe that Mantra, sets a North Pole for us, and merely, by keep speaking it, mentally or by loudly, we began to glide on towards certain directions.

A BIG QUESTION BY SKEPTICS AND ITS ANSWER

A skeptic will ask, "Suppose I do nothing but keep lying on a sofa, and keep saying some Mantra, without doing any other work, will any Mantra help me? Does any Mantra help an idle man?"

The answer may be, "Perhaps, Yes."

Even if you do nothing but keep lying on sofa, and keep speaking a Mantra, it may help you. As soon as the number of Mantra spoken will grow, you will find it impossible to keep lying in sofa, you will start gliding yourself into your work which may be most beneficial to you.

But I am not an authority on this subject. Why don't you try some Mantra while lying on sofa, you may soon find whatever may be the right answer.

THE DIFFICULTY

There are many mantras. You have to choose one, and stick to that mantra to see it effects.

If you keep changing from one Mantra to another, or if you pursue too many mantra, it may weaken its effect.

I asked a very pious lady, "Why was she repeating names of one God only? Why don't she speak names of other Gods also, who are also helpful?"

She replied, If she will start speaking names of other Gods also, there can be quarrels among Gods!

She may be right.

But it means that, if you start speaking more than one Mantra, there could be quarrel among different Mantras! 

And this could weaken benefits to you!

I really don't know.

Many of you may be chanting different mantras, daily morning and evening.

You may know the best.

No permission of Government or Parliament needed to set up an OMBUDSMAN (Peoples' Swaichhik Lokpal) to inquire in to scams, government contracts or public duties MPs and MLAs.

This Article is about powers of OMBUDSMAN (People's Swaichhik Lokpal).
No permission of Government or Parliaments or Legislative assemblies of States are needed for setting up such OMBUDSMAN.

It can inquire into Army Contracts Scams, Government Contracts Scams and also conducts of MPs inside Parliament and outside Parliaments. It can also inquire into conducts of Judges of Supreme Court and High Courts and can also questions judgements of Such courts.

In fact, it has all the things which Anna Hazare wants and it has as much power as Anna Hazare has.

All these statements look bold. You can get them checked by any lawyer or by any Justice. Most probably, all of them will agree with what I am about to say.

They may have some If's and But's, but all of them will agree that no Government permission or passing of any Bill in Parliament is needed for setting up such OMBUDSMAN (Swaichhik Lokpal)


EXPLAINING THROUGH EXAMPLES THAT ACTUALLY WORKED

Example One:

1) Times of India, many years back, appointed former Chief Justice of India, Justice P.N. Bhagwati as Ombusman for its newspaper group.

a) Any complaint against any news item in this group of news paper could be made before this Ombudsman (Swaichhik Lokpal).

b) This Ombusman-Swaichhik-Lokpal, will examine  complanint. If there is any substance, he will issue notice to concerned press reporter or editor.

c) He will examine, if any reply is received.

d) If Press Reporter or Editor does not reply, or if he will refuse to reply, the Ombudsman/Lokpal will record so and will give his judgement and forward it to management.

e) Even if no legal authority is there, it had lots of Moral Authority of Justice P.N. Bhagwati and actions used to follow.


Example Two:

Many years ago, when there were no Lok Adalats, a District Judge in a small District Place, set up an
Ombudsman.

He selected Four Other Prominent Persons of Town.

Every Sunday, they used to sit in an empty store room of a post office.

People who had legal disputes, used to complain to them.

They used to inquire.

Call other side. If other side do not come, they used give judgement. It had moral authority.

They solved many things.


Example Three:

Earle Stanely Gardner, author of Parry Masson books series, set up a "Court of Last Resort"

This was a voluntary body where former Judges of Supreme Court Presided.

If any one had very serious and real grievance against a Supreme Court Judgement, they used to meet, hear parties, and give judgement.

They had moral authority.

Many times, Supreme Court reviewed and re-opened their judgments on basis of such re-commendatory judgements.


THE POINT IS:

There is nothing to prevent people from setting up such voluntary Lokpals of People in any area of public interest.

Such voluntary Ombudsman are working everywhere in world. They are the voluntary Watchmen of our society. In your housing colony, if there are frequent thefts, you decide that some of you will become voluntary watchmen and will keep walking in night in society with sticks in hand.

These ombudsmen are like voluntary watchmen of your colony.

They need only some seed fund to start with.

Everything depends on Moral Authority of Person whom you select as Chairman of Such body.

5000 Years Ago A Mysterious Man Was....

5000 Years ago, a Mysterious Man was born among us.

He used to help us even if we were not his relatives or friends!

He used to help us without being seen and without leaving evidence in such a way that everything he did used to look like miracles to us.

One day we asked him, "Who he was and why was he helping us even if we were not his friends or relatives?"

He thought for a while, and then replied that He was the God Himself.

We started worshiping and following Him. He saved us from all kinds of evils. With his intelligence, He used to lift mountains, as if they were paper weights.

One day we saw that He was sitting under a tree with a poisoned arrow struck in his foot-sole.

We sat silently before Him.

We asked Him, who will help us after He has left.

He thought for a while and then said that He comes here in every century, whenever sins of greedy exceeds tolerance of Glorious and Strong Persons.

He further said that all Glorious and Strong Persons are Parts of Him.

He assured us that whenever we have any problem, we should approach such persons and they will help us without being seen and without leaving evidence.

We again asked him, please tell us, how will we know who are Glorious and Strong Persons.

He said, "Persons in whose presence, evil persons refrain from doing evil on their own, are Glorious and Strong Persons"

Then yesterday, we heard a strange rumour.

Somebody said that You are a Glorious and Strong Person. Then somebody said that when You are around, evil people refrain from doing evil on their own. 


Then again somebody said that You help those who are not your relatives and friends.

If these rumours are true, kindly guide me in my present troubles.

In past whenever, I have been in any major trouble, I have written this letter to unknown persons listed in Who's Who books or to Judges of High Court and Supreme Court and described my troubles. None of them ever replied, but my troubles used to disappear.

This letter is inspired from Bhagwad Gita.

Gandhiji (9) Gandhiji asked Muni Rajchandra," Did Mahabharat and Ramayan Really happened?

This is based on an article in newspapers which I read years ago.

Gandhiji wrote a long letter, to Muni Rajchandra. He asked a list of questions to him about Raamayan and Mahabharat. Gandhiji was a lawyer. He asked pointed questions.

Some of his questions were, as I recollect from reading of article in newspaper,

1) Were Rama and Krishna really Gods?

2) Did Ramayan and Mahabharata really happened? Or are they just poems written by ancients Munies?

Tough questions.

Muni Rajchandra replied to Gandhiji. Gandhiji accepted his reply. Then it is matter of general knowledge that Gandhiji worshiped  Ram and Krishna as God. Whenever, he needed spiritual power, he turned to Rama. Whenever he needed philosophical guidance he turned to Krishna.

BUT WHAT WERE THE REPLIES GIVEN TO HIM BY MUNI  RAJCHANDRA?

I recollect as under.

Regarding First question, Muni Rajchandra said, "Whenever any God has to come to Earth, he will have to come only through a human being. Therefore, there is no harm in believing that they were Gods."

Regarding Second question, he said, "Since Thousands of years, people are believing that these are narrations of true events, there is no harm in believing that these wars really happened".

Like you, I also paused when I read these answers. Aren't they evasive answers?

Now considers, you are told that, there are 200 hundred galaxies are then in sky. You have no means to verify what some persons are saying. Then you will tell yourself, when there are so many people saying like this, There is no harm in believing that there are 200 hundred galaxies in sky.


Same way, when there are things which we cannot verify by material standards, the way to believe some thing true or not, is as above.

Perhaps, so Gandhiji to believed in Rajchandra Muni, and made experiments. He found, a flow of spiritual energy supplying him strength. So his belief was confirmed that Rama and Krishna are also Gods, like so many other Gods. He never said that his were the only Gods and others had no Gods.

Now, I have also made experiment and found that these Gods help us. The only thing is they are not at our command. They are unpredictable. When they will help, how they will help is entirely unpredictable. But we can certainly feel their presence in our room the moment we remember.

Whatever it may be. Many of you may also have made experiment with Gods and might have real personal experiences which you cannot prove to anyone.

It doesn't matter. This is not an authentic blog. This is for recording my personal recollections only. You are entirely free to reject what I have said.

Gandhiji (10) Gandhiji's First Law "Good of One is included in Good of All"

I am not Gandhian, nor I have read much about him. So I am not qualified to formulate his laws.

But since I see no Gandhian talking about his laws of universal application, I think I may try it on this my personal blog for my own use.

I can formulate First Law of Gandhiji as thus:

"In Good of All, Good of one is included".

This law can have universal application.

For example, if a Nuclear Plant is Good for all, it can be presumed that, good of local nearby people is included in it. It does not matter if they have to suffer some risks.

Same way, this law can be applied in many other areas of universal application.

I am not sure and I may be mistaken. So I will keep correcting this and other posts on this blog as I will learn new things. Like to all other blogger community, this blog writing process is a learning activity for me.

Two Strivings of Almost All Human Beings

About 40 Years ago, I had read a book by Alfred Adler, titled Understanding The Human Nature. It impressed me for years.

The book says that all of us have Two strong Drives:

1) One Striving For Superiority. We want to be superior than all others. Some of us also want to become God, Some wants to become a massiah, some wants to become Mahatma, etc etc. basically all of us are striving to be superior than others.

2) Secondly, he said, all of us are striving for recognition. We want to become recognised. Some want publicity on TV, Newspapers, Internet, twitter etc. He said that basically we are all striving for recognition.

Then he explained how these strivings formed in us.

When we were young at about 3 to 4 years, we began to see around and recognise the world.

We saw that every one else in family was bigger, taller, and stroger than us. So we also started striving for becoming bigger, taller and stronger like other family members. Basic bricks were started forming in cells of our brain. And thus we developed a life-long striving for superiority.

Then we saw, every time we cried, every one looked at us. When we let out a naughty smile, everyone looked at us. As a child we were afraid to be left alone. So we began several methods to attract attention towards us of our family members.

This became our life-long striving for recognitions.

According to him all our actions, careers are directed to fulfill these strivings.

My somewhat doubtful views on entry of FDI in Retail in India

I am layman. I don't understand economics. But my heart says, FDI in retail is not good for me and you.

My heart gives me following reasons:


(1) In earlier blog post, "How one man can stop parliament from passing any bill" , I referred to a hollywod movie NETWORK. This movies was exactly on power of one man to send a telegram to Prime Minister and ask him to STOP before going further.

Please refer to same post if you are reading this first time.

Further story of Movie.

When millions of Telegrams flooded White House, the deal was put on hold. The TV Anchor who opposed deal and asked people to send telegrams, is called by a Rich Diplomat at his house for a talk, and there, he explains America's Interest in going ahead with deal.

He mainly gives TWO following reasons:

(a) He shows a plastic comb to TV Anchor and says, "I am a salesman. If someone asks me to sell this plastic comb for one million dollars to a foreign country, it is my job to do it. I can do it"

(b) Billions of dollars of Amerca are going to Arab countries by way of oil payments, by way of aids, by way of wars etc. All these money must come back to America. This is the simple economics. This is why you should tell on your TV show to all people that this proposed deal is good for America.

The TV Anchor refused to do so. In next TV Show, he was shot dead in front of TV Cameras and when whole nation was watching.

There the picture ends.

CONCLUSION : WHATEVER MONEY WILL COME TO INDIA THROUGH FDI IN RETAIL SECTOR, WILL AGAIN GO BACK TO FOREIGN COUNTRIES WITH LOTS OF PROFIT. SINCE IT IS RETAIL SECTOR, YOU AND I WILL FEEL THE SQUEEZE.


(2). ARGRUMENT TWO: RETAIL SECTOR IS VEIN OF COUNTRY. HERE POTATO, ONION AND SALT WILL ALSO BE SOLD AND THEIR PRICES IN MARKET WILL BE DECIDED BY COMPANIES SITTING ABROAD.

NOW imagine, position of then Ruling Government of India, if these Foreign Companies decide to INCREASE PRICE OF ONION AND POTATO by three times! The Government of India will come under perpetual blackmail of these foreign companies and this will start ruin of an econimically strong nation.! Please halt here, and read this para again and try to understand things which I have avoided saying.


(3) REASON THREE : Entry of FDI will bring huge amount for building Big Retail Malls. Whom this Building Contracts will be given? Of Course to kiths and kins of those political leaders who facilitated entry of FDI. May be also to kiths and kins of Opposition parties also.

Since entry of FDI in States will be left to each States, thses contracts may also go to kiths and kins of State Political parties if they are in construction or retail good supply business.


FINAL REASON :

Remember, Three Idiots movie starring Amir Khan ?

Put your right hand on left side of your heart, and ask it, if All is Well with FDI in retail?

If answer comes yes. Fine.

But if answer comes No, then just don't rely on opposition or political parties
or on any one else to protect interest of your country.

I have done my little bit by writing this and publishing this on blog. I can do nothing further.

I may add a recent observation. Some years ago a company opened a department store to sell vegetables. At that time there were Two nearby vegetable markets run by poor vendors. People used to go there. Then suddenly police raided on these two vegetable markets ran by poor vendors and closed the markets.

Even then, the Store could not make profit. The Store finally closed down. And the two vegetable markets run by poors are back in business at same place.

The point is, once the FDI Retail will come, it will be main job of all government departments that these companies are happy. Small retail shops will be wiped out if it is necessary for companies to take back profits to their home countries.

I will welcome FDI in Retails if it comes to India. I will be happy if they appoint me as their legal counsel for their Supreme Court matters. Because that is my living.

How Police & CBI Officers became vulnerable to politicians?

This article is about some judgedment and some provision of law, because of which, India has become a "ZERO SAFETY NATION".

POINT 1 :

WHERE HAVE WE REACHED AT PRESNT

Only few days ago, a bench of two Judges in Supreme Court was hearing a Habeaus Coupus petition asking for release of some persons illegally confined to Indian jail.

One judge could not help expressing his anguish.

" Article 21 Life and Liberty of an induvidual has alaways been a most jealously guarded subject by Supreme Court.

In fact, we have given a guarantee under Art.32, that we will proretect life and liberty of every individual.!

Remember those days when Hebeaus Corpus petitions, were always listed on top board and petitions were decided in a week...! !

Now ! ! ! Look at this Habeaus Corpus petition which is lingering since 8 years, and the government is still asking for time!


Where have we reached!


Haven't Government Counsels any duty to Court?"

Judges expressed their dismay.


POINT 2 :

WHO SHOULD BE BLAMED FOR PRESENT SITUATION?

I think, Supreme Court itself
should be blamed
for the present scenario. I will try to explain why Supreme Court itself is alone responsible for this state where we have reached.


POINT 3:

AN.EYE-WITNESS WHO SHOW POLICE ADMINISTRATION CRUMBLING DOWN TO GROUND ALL OVER THE COUNTRY AFTER A SUPREME COURT JUDGEMENT IN 1983

Scene before 1982.

It was not much better, but at least something better.

A) If a Chief Minsiter asked a PSI to clean her shoes, in front of TV Camera, he could refuse to do so.

B) If a Home Minister asked a PSI to buy 1 Kg Potato from market and deliver it to his home, the PSI could refuse to do so.

(C) If a Chief Minister goes to a police station asking for release of her party members, PSI could tell her, "Madam Chief Minister, this is My Police Station. You have no right to interfere in my investigation. These people are arrested as per law. Go to Court and come with their bail of order."

But now things are different. Police officers are ready to do anything including encounters, to oblige their top bosses.

In my view Change happened due to a 1983 Supreme Court Judgement.


POINT 4 :

WHAT DID I SAW IN 1983

I was actively watching working of police system. My sources of information were newspapers in public libraries.

I was just trying to understand why so many mysterious deaths were taking place across country. I was trying to see if they were following some kind of patterns described in Sherlock Homes Books.

In this books, the detective said, "All kind of crimes of world, follow only few fixed patterns. Once you identify these few patterns, you can find out who committed crime in few minutes even without going out of your room!."

He said all crimes can be solved by sitting in a room by following deduction methods.


Just then I read in newspaper, a land mark judgement of Supreme Court.

POINT 5:

WHAT DID THIS SUPREME COURT JUDGEMENT SAID

The judgement said a government servant has no fundamental right to serve at any particular place.

Government can transfer him to any place in India at any time.

There were guidelines on how transfers are to be made to avoid arbitrariness. But Court said, forget about these guidelines. Once we say that you have no fundamental right to serve at a particular place, you can derive no right from these guidelines. The guidelines are for government's internal working.

No Stay on Transfers. Sorry. Follow wishes of your bosses.

But why High Court and Supreme Court will not protect a PSI, if a PSI is transferred to a remote place, only on the ground that he refused to polish shoes of Chief Minister?

Court Said: You have to prove malafide after joining Chief Minister and proving prima facie evidence of malafide.
(An impossible thing to do)

And in anyway, we can't grant you any stay. First, Join at transferred place and then we will hear your case as per availability of date of listing your case. Normally we give next date of hearing after six months, but in your case, we will give next date after four months.


POINT 6. NET RESULT OF ABOVE LAW;

Few Days ago,

1) On TV, we saw a police officer cleaning shoes of chief minister.

2) On TV, we saw that a police officers arrested two persons of a political party. Chief Minister herself goes to police station and the accused are released.

3) Fake encounter by police of UPA party workers in BJP ruled states and Fake encounters by police of BJP workers in UPA ruled states.


CONCLUSION: Every police officer, in India serves at the mercy of Chief Minister and Home Minister. If he does not carry out investigation or encounters as per wishes of minister, he can be transferred to any remote place any time.

Every CBI Inspector is at mercy of Union Home Minister. If he does not investigate as per wishes of Home Minister, he can be transferred to any remote place .

No courts will grant any stay against transfer as per law as I understand since 1983

These brave people have families and small children studying in school. Welfare of all of them is at mercy of Home Minister or Chief Minister.

How can we expect them to investigate fearlessly?

POINT 7

SAME FATE HAPPENED TO GOVERNMENT PLEADERS, STATE COUNSELS,
PUBLIC PROSECUTORS.

Supreme Court held, all these posts are contractual posts. Prosecutors have no right to post. As soon as Government Changes, it can replace all prosecutors and place new prosecutors who can conduct cases as per wishes of new ministers. So if a minister wants that in certain case all accused should be acquitted, the public prosecutor has to ensure that they are acquitted. Otherwise, he will lose his job.

These State officer, prosecutors, standing counsels, also have family and children studying in school. Why should they take any risk if Courts were not likely to protect their job!

This is why I think that India is "Zero Safety Nation".

Gandhiji (11) Can One Single Man Stop Parliament From Passing Any Bill?

I would like to explain this point to you( 1) By one example of Gandhij  (2) From movie "Network" and (3) From some basic principle of Law of Evidence. (4) From a personal experience.


1) Gandhiji's example :

He was in South Africa.

Some Bill was likely to be passed in Parliament against Indians in South Africa. Time was very short.

He asked people (1) to send telegrams to all members of Parliaments.(2) He asked people to collect at least 25000 signatures.

As soon as the telegrams reached, the Bill was put on hold. Then he also sent memorandum of 25000 signatures.

Here, we stop. It is enough to see that Bill was immediately put on hold. Further story is not needed to explain point which I wish make.


2) Movie "Network" Story.:  

 A TV Anchor was running a popular TV show where current political situations were discussed and analysed.

Some one was preparing script and he has to play it.

He saw that everything which was being shown to TV Audience was fake. People were being fooled.

One day he goes mad.

Instead of speaking as per prepared speech, he began to start speaking from his heart. He began to speak that what was being fed to people on TV was fake, and then he began to explain true political games.

Since, it was live show and he was "On Air", it was difficult to stop him.

He kept pouring out his heart for 45  minutes. After the show was over, management decided to remove this man who had gone mad.

But by evening, his show had become a Hit and everyone wanted his more shows.

Management felt, it was commercially lots of profitable to continue his show. He was continued and was allowed to speak whatever he wished.

His show began to increase TRP of channel by day and night, by leaps and bounds. He no more used notes or prepared speeches. He spoke directly from heart and people liked the truth.

Then one day, One America's leading News Channel decided to sell all its shares to an Arab Country.

The Anchor spoke against this deal, in his show, "This is not good. This news channel is soul of America and it cannot be sold away to a foreign country."

He asked everyone to send a telegram to President asking him to stop the deal.
In 24 hours, millions of telegram reached President.

The deal was put on hold immediately.

Here we stop the story.

3) Basic Principle of Evidence:

Whatever is spoken or written, if it is verifiable by a third independent party, it is a strong and almost undeniable evidence.

When you send a telegram, the telegraph office man reads what you have written. He counts words. Then the telegraph office, where the telegram reaches, downloads it, reads it, and delivers it.

It has impact on the receiver of telegram.

I have found that if you send Registered AD letters to all members of Parliament and Rajya Sabha, no one cares.

If you write to PM or President, no one replies.

This Telegram method, I have still not tried on members of Parliament.

But when some client will come, with right cause and capacity to bear expanses, I will ask him to send telegrams to all members of Lok Sabha and Rajya Sabha.

Then we will see the reaction.

4)  My one experiment: 

I have made many experiment with telegrams. But one is enough for this article.

Some years ago, One day, I feared some anti-social elements. I sent a telegram to chief Justice of India. That day at night at 2 AM, two police officers came on a bike near my house.

I was frightened. I felt that anti-socials had come. But no, they were police officers, they checked my name plate on house and checked that everything was peaceful in area.

Next day morning, again two police officers came, they gave me their personal mobile numbers and told me to call them if I need any help.

Then I saw that a Police PCR van was stationed for six month in my area.

This is my experience.

(P.S. The recollections of about Gandhiji might have some incorrection, because I am neither Gandhian nor I have read much about him. Recollection about movie Network are also from far memories.)

How Attempts To Weaken Supreme Court Have Failed Several Times.

At present, Supreme Court is the STRONGEST Constitutional Institution in India. It has tied up whole country together. It decides cases against highest and mightiest in the country and it commands utmost respect of entire country.

Recently, Shri Nitishkumar, CM of Bihar made a statement, "If Biharies will not work for even one day, the whole Delhi will come to a halt."

One wonders, why such statements are made to divide Indians into, Bhihari, Gujarati, Maharshtrian, North Indian, South Indian etc.

In Supreme Court, we never hear such words. Here whole county is one. All lawyers are one. All Judges are one. There is nothing like "a Gujarati Judge favouring Gujarti lawyers, a Muslim Judge favouring muslim advocate or like such cheap things."

All Judges treat all lawyers equally and almost all parties equally. There is nothing like groupism in Judges also. At High Court level we often used hear that judges have formed gorups and they favour relatives of judges of certain group.

But thank God, I have never heard such things in Supreme Court. In my view it is the most impartial court in the country.

BUT THIS ARTICLE IS ON DIFFERENT ISSUE

This article is not about praising Supreme Court. In past, attempts have been made to weaken Supreme Court. Some Parts of Supreme Court are already weakened.

My attempt is to tell you about this from my recollection.

FIRST MEMORY:

In a retirement welfare party, a Supreme Court Judge said to lawyers, "We do not have threats from outside. We have threats from inside."

He was trying to tell us that, if Supreme Court will be weakened, it will not be an outsider's Job, but it will be an insider's Job.

This was a great brave judge who had directed that land allocated to a Former Prime Minister of India, be returned back to Government.

SECOND MEMORY :


An attempt was made to set up FOUR SEATS of Supreme Court at various places in India. The ostensible argument given was, "Poor People of India are finding it difficult to travel to Delhi to file cases in Supreme Court."

To me, Real idea appeared to be bring Supreme Court under Regional Governments Influence.

This idea failed.

THIRD MEMORY : 


An attempt was made that Periodical Benches of Supreme Court may sit in different parts of country for different periods.

Again, arguments and idea looked same.

This proposal too failed.

FOURTH  MEMORY: Only recently, attempt was made to again set up Supreme Court in Four places in India.

Again the arguments were same. To me, real reasons were "Political Class's desire to increase Regional Influences on Supreme Court.

FIFTH MEMORY :


This is something which is happening RIGHT  NOW, when you are sleeping.

India's Supreme Court is considered STRONGEST SUPREME COURT IN ENTIRE WORLD.
Because here, Judges Themselves Appoint New Judges to Higher Judiciary. In other Countries, Prime Ministers and Presidents have powers to appoint judges. In India, after 1993, they have no such powers. Therefore, India's Supreme Court is considered Strongest Supreme Court in India.

Some people. Who Want A Share in The Cake, are arguing for setting Judicial Commissions and Accountability Bills.

Their arguments are that They Want To Strengthen Judiciary.


But in reality, according to me, they want to weaken the Judiciary and they want a share in the Cake.
This is happening right now. Any Day.


Opposition not likely to oppose, because they too want a share in the cake.


SIXTH MEMORY :


This is about power of Supreme Court under Art.32.

This damage has already been done.


Earlier, Article 32 was a Radar scanning all over country. The Judges used to use this power to keep scanning country for massive injustice.


Now this Radar has either stopped working or it has lost capacity to scan whole country.
This has happened due Clogging of cases in Supreme Court. Less appointment of Judges. Records room has fewer places to keep cases.

In such atmosphere, Art. 32 is used less by Supreme Court.

Power Slips Away From Hands Which Are Not Capable Of Holding It

When Britishers left India, people of India and Pakistan were hardly capable of holding Power in Their Hands.


Power slipped from them into hands of few dozen people who ruled these two countries to serve their own interest.


Much of our resources are lost.

Today what power is left in Our hands?

1) Media is not with us. They are with the advertisers.

2)MPs and MLA are with high commands of their party. They owe their existence due to their obedience.

3) Debates in Parliament and Legislative parties are rarely seen. Purpose of Democratic representation in Parliament is not seen.


4) Good people do not want to contest election due to fear of criminals.


5) Thus, practically, home-rule obtained by us in 1947 is lost.

THEN WHAT POWER WE ARE LEFT WITH?

1) Power to Ask. We can ask Power from those who have taken it away from us, They may not give us easily. But we do have Power To Ask and Keep Asking till we get it.


2) Power to Stay Away from Functions of Ministers, MLA, MP etc if Power is not restored in our hands.


3) Power To Request Foreign Journals to help our cause. They do not get advertisements from here. They may help us.


4) Power to try to understand what is the meaning and object of each bill passed by Parliament.


5) Power to gather support in non violent way for right causes.

Rallies catch media attention but they serve little purpose. On the other hand a group 12 persons with right resources can do a lot more.


I think it right time to think and work about this.

Gandhij (12) Why Gandhiji Permitted Killing of Monkeys in Madhya Pradesh?

As per one book on Gandhiji, written by a foreigner, in 1930, Gandhiji visited a village in Madhya Pradesh. In those days, monkeys used to come in groups and destroy the crops of farmers. Madhya Pradesh Government had announced reward of Rs.50/- for every Monkey killed by villagers.

Some farmers asked Gandhiji, "We want to follow non-violence. But please tell us whether we can kill monkeys and follow non-violence both at same time?"

Gandhiji said, "If monkeys are destroying your crops, there is nothing wrong in killing them."

This he said in 1930.

He died after 17 years. In the mean time he may have changed his mind. We do not know.

But he always said, "Nothing what he said was his last word. He was doing only experiments with truth and non -violence." He reserved his right to change whatever he may have said previous day."

We have unnecessarily frozen all his words in marble statues..

Violence and Non-Violence, both are war strategies. Only those who are expert in war should experiment with this.

Same way, every one cannot say what is Truth and what is Untruth.

Because, Untruth is wearing dress of Truth.

And Truth is dressed like untruth.

All paid-media truths could be Untruths dressed as Truths.

Gandhiji gave a simple solution.

He said, "Definition of Truth is hidden in every heart. Just ask your heart what is the truth? You will know."

Let us make an experiment.

I have not produced any reference on when Gandhiji permitted killing of Monkeys.

Ask your heart, whether this fact is true or false.

You will know the answer.

Tragedy of Coalition Governments and Easily implementable solution

We have seen tragedy of Principle-less-Coalition Governments.

They work on Barter System. "If you will let me loot country in this area, I will let you loot country on other areas.

This is how a coalition Government works.

WHAT IS THE EASILY IMPLEMENTABLE SOLUTION?

At national level and Regional level, there should be only TWO PARTIES.

One Democratic Party and Other Republican party. You can be either member of this party or that party only.

HOW CAN THIS BE EASILY IMPLEMENTED?

All political parties will say, NO, No, No, No.....

But their Yes or No is not required. Any one can register such two political parties. And people can start Joining either of these parties.

First, members will trickle, then more and more people will accept it.

In ten years form now, we can forget about Jugad-Parties and Coalition Governments.

I may be wrong. But the idea is worth circulating and thinking.

Do You Know Two (Secret) Rules of Top Political Leaders

This a very short post. I know only two secret rules of Top Political Leaders. I call it secret because no political leader will admit that he is following these rules. But from his conduct, you can see that he is following these Rules.

Rule 1. Be Like a Traffic Constable. 

If traffic on one side is more, open it and let it go to other side. Thus keep giving sides.

Rule 2. Do nothing. 

Whatever you do, half of the voters will support you and other half of the voters will reject you. Either way, you will lose half of the voters. But if you do nothing, you can keep trust and hopes all voters.

Try to check, how many top political leaders are following these rules.

How Gandhiji Used "Foreign Peer Pressure" to pressurize Government?


How Gandhiji Used "Polite Peer Pressure" method to persuade Government to accept his requests?

I think he used three methods.

1) "Polite Peer Pressure" method.
2) Non-Cooperation method.
3) Civil Disobedience Movement.

How Polite Peers Pressure Method works.

These words "Polite Peer Pressure" do not find place in Gandhi Literature. But this can be spelled out from the fact that one of his close supporter was a foreign correspondent reporting his actions to foreign media.

An Example of How this method works.

Without going into details, I may just give you an example:

Suppose a crime against woman has taken place, in a UPA ruled State. Chairperson, of National Commission of Woman is not acting because of some political embrassments.

Understandable.

Now instead of tweeting or emailing to NCW, you should send tweet and emails to British National Woman Commission, U.S.National Woman Commission, French National Woman Commission etc.

It costs nothing except some of your time. Some of this International Woman Commission will ask, India's National Woman Commission whether facts in email are true?

Indian National Woman Commission will reply to International Commission that facts are not true, "We had already taken action on this two days back"

This will serve your purpose. This is called moral pressure from International Community or you may call it Peers Pressure.

Do not mind if International Commissions do not reply you. They will do their job as per their moral conscience.

If Gandhiji were alive today, would he be on twitter or blog?

(This article is based on my personal imagination. My apology to those may disagree with my imagination.)

Gandhiji said, a leader should clearly say what people should do. He should say it in simple language, so that, people can easily understand. And it should be within their power to do what you say.

He asked people to spin cotton by moving spinning wheel (Charkha) at least three hours a day. It was a very simple thing to do. People could do it at home.


They need not go to protest rallies. They did not have to take stick blows from police.

They did not have to do Jail Bharo Andolan.

It was legal to spin wheel at home. Gandhiji asked them to do only this much.

People began to spin wheel at home. In quantity of millions!

The result followed. Textiles mills in London closed down. British Govt's income from India declined. Expenditure for ruling India became higher than income from India.

They left India.

WHAT GANDHIJI COULD HAVE SAID IF HE WERE ALIVE TODAY?

He may have asked you to spin wheel. Or Instead he would have said, "Tweet and Retweet" for at least three hours a day.

It is very simple thing to do. We can do it at home. We do not have to go and join any rally.

We do not have to bear stick blows of police. We do not have to join Jail Bharo rally.

And it is legal to tweet and retweet. So we can do it easily.


DOES IT MAKE ANY DIFFERENCE TO GOVERNMENT?

Yes. It made so much difference, that at one stage, Government had to declare Intention to Censor Social Media.

Again people tweeted and retweeted.

Again, Government had to retreat and say that it had no intention to censor Social Media.

So, Tweeting and Retweeting do make difference. Somehow somewhere. I am not sure though.


SUPPOSE, IF WE ASK GANDHIJI, about what should we tweet and what should we retweet,
HE WOULD HAVE ANSWERED LIKE THIS:

"Those of you who want Judicial Reform, should open a twitter id, called @Jidicial_Reform. Then they should tweet and retweet only on this subject. If followers will increase, it will have impact.

"Those of you who want Electoral Reform, should open a twitter id @Electoral_Reform and start tweeting and retweeting only on this subject.

"Those who want reforms in SEC.498A of IPS, should open a twitter id @498A_Reforms, and then tweet and retweet only on this issue.

"In this way, all of you should choose a subject of your choice and then tweet at least three hours a day."

SOME OF YOU MAY ASK GANDHIJI, "WE ARE ALREADY DOING THIS SINCE MONTHS, BUT WE ARE NOT SEEING ANY RESULT".

To them, Gandhiji would have said," The doors of heart of your enemy should be opened from inside. You cannot force open doors to their heart from outside. If in your tweets, you will use harsh and barbed words, then, the enemy will not open door of his heart from inside. To use barbed words is a sort of violence. It does not help.

"If you condemn media as "Paid Media", no journalist will think about correcting his/her ways. They will not open their hearts from inside and your tweeting may not work.

So, the common thing between a spinning wheel and Twitter is, both are weapons of mass awakening on a given subject.

Why India Needs 10 Times More Budget For Judiciary?

People all over India criticize Judiciary for 3 Crore Arrears. But does anybody asks how much budget is allocated for setting up new courts and judges? How much courts are needed in India? How many judges are needed in India? Nobody will give you any specific reply.

 Because no study is undertaken by any NGO or Institute to study this aspect of Judiciary.

Out of 350 Crores cases, 150 Crores cases are about people fighting against Government for their dues or disputes. Isn't it obligatory on Government to set up new Courts and to appoint 10 times more Judges?

2G Fame Justice A.K. Ganguli said TWO  important things, about which now all of us have forgotten.
These are the Two Things which he said:

1)    Judges are working under tremendous pressures. Threats are conveyed to them through relatives of judges.

2)    When he was Chief Justice of a High Court, he show that daily 750 cases were listed before a magistrate.

What can a judge do if you bury him under 750 Cases a day? What can a Judge do if we do not insulate him against even remote threats?

We ask them to decide scams involving Lakhs of Crores. Do we give them and their families any security? Why we are not giving them any security after they retire?

After retirement what can happen to a judge if he had ordered hanging of a Boss of a Terrorist Organization?

Out there in media there is too much noise about non-issues.

Do we really deserve a good Judiciary? 
That is the question.

How Does a Lawyer Feel When He Reaches At Top of Legal Profession?


 
A Three Part Poem

And when he reached
On top of a mountain
He saw Absolute Silence
And Profound Loneliness
Waiting to greet him

“Once or twice in every century
Someone like you comes here
To meet us and to be a part of us”
They said in a voiceless language
Smiling warmly at him

Then he looked down the mountain
Every one below looked so small
In size and thoughts!

He wondered whether
He really belonged to this planet!

Then some thought struck him
And he just laughed
“These are all just images!”
He whispered to himself

And when he looked up at the sky
For the first time he heard
Melodious sounds
Which the stars where making
While twinkling with one another

 The whole sky came alive
With melodious tunes of stars!

They were talking with one another
And he soon began to understand
Harmonious language of stars

It appeared they were souls
Of immortal men and women
Who lived here centuries ago

One of them twinkled at him
As if to ask something to a new climber!
And next moment it twinkled again
As if it had got the answer!

 They knew him!
They knew him all along!!

He was after all not lonely
On the top of a mountain

The Age, the biggest thief of time,
Was playing mischief!

Or may be all his memories
Had become trivia!

He was neither living
In memories of past
Nor in hopes of tomorrow!
He felt free from bonds of his memories!

“Which values
Did you sow on Earth?”

“Oh!” He was taken by surprise
Little star didn’t want to know
About his acquisitions, achievements and combats!
He also did not want to know
Height of mountain he had just climbed!
He was asking only about his farming skills!!

Back in his village an old farmer used to live
He wondered he could be still alive
Next time he would visit his village
He would ask him about
Science of sowing seeds of values
In memories of mankind

And then he would come again on this mountain
To reply to this little star

MUST RD FOR LAWYERS: How to address HC or SC Judges who may be behaving rudely with Lawyers and Litigants?

What is this?
Am I some kind of a frustrated and rebel lawyer who keeps venting abuses against judges after losing a case?

The answer is no. I am a very calm and courteous advocate. I am usually detached with result of my cases. And I do not indulge in defamatory gossips about judges.

Since last one month, I am taking some kind of psychiatric medicine under guidance of a psychiatrist to overcome my low self esteem. It has opened of a can of worms in my head, the worms which were lying there since years. These articles are only worms coming out from my head.

All my articles are under influence of DENLAFAX, which should not be taken except under medical supervision.

ABOUT  THIS ARTICLE

PRESUMPTIONS  ABOUT ARROGANCE OF SOME  HC & SC JUDGES

1) At present they are not under control of anyone. Whatever may they do, they cannot be removed except by Parliament.

2) All of them have discretionary powers. Whether they pass right order or wrong order under this power, the order cannot be changed by superior courts.

3) Even, Chief Justice of India has no power under any laws to censure any such SC and HC Judge.

4) Therefore it is possible that some judges may develop borderline rudeness based on their own Moral-High-Ground, or "Holier than Thou" attitude.

SO THE QUESTION IS,

"What a lawyer can do if he feels that the judge is addressing him rudely and is insulting a lawyer in presence of his clients, when he is arguing case of his client before such a Judge? i
ONE NON -EFFECTIVE ANSWER:

Lawyer may complain to President of Bar Association, who may convey it to Chief Justice, and Chief Justice may convey it concerned Judge.

But this may not work. Sometime it may be counter productive and judge may become vindictive to lawyer.


SOME SUGGESTIONS:

OPTION   1)Take it lightly and forget. Presume that we are still under British Colonial Rule and we are still slaves and to maintain dignity of Judiciary, we should swallow all the insults that this judge may give to us or to our client.

OPTION  2) Judges are very sensitive to the way you address them.

The Convention is that they should be addressed as "My Lords" or "Your Honour"
It is also convention that after they rudely dismiss your case, without answering even valid points, you should still say, "I am obliged, My Lords".

But there are no rules that this is the way one should address.

A lawyer filed petition in SC, that this colonial system of addressing judges as "My Lords" should go.

The then presiding Chief Justice Y.K. Sabhrawal said, "We do not insist you to address us as "My Lords"
Go to Bar Council. This is a problem of Bar"

Lawyer went to Bar Council of India and Bar Council passed resolution that "Henceforth, the judges should not be addressed as my Lords"

But lawyers continued their old habit of addressing judges as my Lords.

So one Delhi High Court Judge, put it on notice board, "Lawyers appearing in this court should not address me as My Lord and should address me only as "Sir."

Even then barring few Senior Advocates, all other Senior Advocates and other advocates continue to address judges as"My Lords" due to old colonial habit.


CONCLUSION

1) So if you feel that any particular judge is behaving rudely with you, start addressing him as "Sir"
instead of "My Lords"

2) First, you should implement this suggestion. If it works well and if its safe, then and then only, I will start following you.

Till then, I will continue to follow old colonial habit of saying "My Lords"

After all, this is a question of "Which mouse should go to put bell around neck of a Cat"?
I am certainly not a fit mouse for this job.

Why Yam Raj had to return without taking life of a Supreme Court Judge?


In India, Yam Raj is name of God of Death.


Year 2043
In bungalow of the retired judge

As the judge was still writing something.
The Yamraj came
Accompanied by a battery of senior advocates’ ghosts

Judge looked up at them and asked,
“Yes. What is your Case?”

“Yamraj said,
“It is our case that Your Lordship's time is up!
We normally don’t allow people to live on this Earth
for more that 100 years!”

“Give me some facts and dates”
The Judge asked,

A Ghost of a Prominent Senior Advocate came forward

And gave judge his birth date,
Along with a true certified copy of Judge's birth certificate!

Judge noted the date and asked,
“How do you compute 100 years?
What is the system of year that you follow?
How many days are there in a Year according to you?

Yamraj replied proudly,
“I follow British Calendar Year”

Judge asked,
“Let us see statutory definition of
‘British Calendar Year’

Senior Advocate replied,
“I have checked up
There is no statutory definition of
Term ”British Calendar Year”

Judge asked,
“Did you check up in law dictionaries and law lexicons?”

Senior Advocate replied,

“I checked up every dictionary including
Devil’s Dictionary,
But the term British Calendar Year
is not defined anywhere”

“Did you check up in British Statutes?”
Judge asked

“I checked that too.
Calendar Year there is defined,
As calendar year of some other country

"The term British Calendar is not defined
On their statue books also.”
Senior Advocate replied

“It can’t be believed.
The term 'British Calendar Year'must be in circulation
In India ince 400 years.
"It must have been defined in some
Privy Council Judgements.

Did you check up privy council judgements?”
Judge asked

“That I have not done. Sir,
Give us some time”
Senior Advocate said

Judge said,” You see! This is crucial.
Unless we know how many days
Are there in a British Calendar,
We cannot compute the period of 100 years!”

Senior Advocate agreed and prayed for time
Judge granted time as prayed for
And started writing another law book.

On their return journey,
Perplexed, Yam Raj asked ghosts of Senior Advocates,

“What happened? Why are we returning?”

“Judge has given us time
to find out some privy council judgement
on term “British Calendar Year”
Senior advocate explained.
