S-74 Thought and Behaviour Connection...Cumulative thoughts mould behaviours

Perhaps our thoughts dictate our behaviour.

And people like or dislike us on basis of our behaviour.

So working on improving our behavior not possible unless we start working on improving our thoughts.

And how can we improve about 50,000 thoughts we daily think? They happen inside us!

All attempts to change behaviour without changing our thoughts are short lived.

In order to change our thoughts, we have to

1) Learn to watch our thoughts as they fly one by one and

2) Learn to first classify them in two categories

a) Helpful thoughts
b) Unhelpful thoughts.

This process itself is hard.

Only after mastering this process, we can move to next process of cleaning our thought process.

Once thoughts are cleaned, behaviour changes automatically.

S-73 Two Types of Lawyers and how their fate turns out to be.

There are two types of Lawyers:

1) Those who like to sit inside Court Rooms and

2) those who like to stay outside Court Rooms,  preferably in Bar Rooms, Bar Library,  canteens etc.

There is some Law of Attraction which says that "You Attract More Of What You Do."

So eventually, type 1 Lawyers get more Court cases and they get more reasons to stay inside Court Rooms whole day.

Whereas type 2 Lawyers, get more reasons to stay away and outside  Court Rooms ! ! !

S-72 A Senior Advocate who used to order and distribute sweets to members of Bar

A Senior Advocate who used to order and distribute sweets to members of Bar whenever India won a cricket match...!!

His name was Justice S.B.Sanyal. He used to sit in Library No.1 in Supreme Court.

He passed away few months ago.

I have yet not seen any other Senior Advocate continuing his practice of distributing sweets to other members of Bar whenever India wins a cricket match.

This is all about sharing your joy with others members of Bar.🌼👏🌼

S-71 Advice to a new ethical lawyer

Dear New Ethical Lawyer,

This is about your desire to do only ethical legal practice and to only fight for justice and dilemma you often suffer.

I would like to say this:

1) A lawyer's duty is to see that a Judge is properly informed on all facts and Law before he passes judgement against your client. This a lawyer can do as best as he can, whether he has breif for this side or other side of a case.

2) It is not his duty to get justice done. Neither Judges nor Lawyers, nor clients know all about Justice in a case. They all try to give right decision about what they see in the case paper book. Many things are never stated in case paper books.

Try to find out and read a book called "Letters to a Young Lawyer" by a famous foreign lawyer. You can search online.

3) Try to look up meaning of word "Pragmatic Decision".
It means whatever may you personally believe, whatever may be in theory, whatever you may have declared in past, but, but, but you have to take a decision which is right in present scenario of circumstances now placed before you.

S-70 Tips for young Advocates : Gets some Mastery in Election Laws

Gets some Mastery in Election Laws and you will be of very much interest to Political Class.

Elections are typical laws. Once you learn A to Z of election laws, you will be needed by political class.

I know an advocate who learned this law well. Theteafter, in every election petition he was either for petitioner or for respondent. He became Justice of a High Court. Twice in his career, he was offered ticket to contest election of Member of Parliament.

He was always in demand by political class.

You do not need an actual client to learn election law. Just spend a month with books of Election Laws. You will learn enough to talk impressively.

LR-44 Advice to a student desiring to file PIL about injustice in school/college

Dear Student,

This is about your desire to file PIL in High Court about injustice meeted out to students on campus.

In my view, students should not enter in such disputes. They suffer backlash at time of exam results. They get poor marks in Exam as per what I have heard.

2) Anyway, even if you wish to file PIL,  you have to first find out which law, which circular or which resolution of Govt is violated by school/college authorities. 

Judge s can direct them to do something only if you show that that school / college authorities have acted in violation of some law, some Govt circular, some Govt resolution.

3) Instead of PIL, particularly, when you are not aware of all facts, and when your RTI are not being replied,  it is better to file a civil suit in trial court. In suit you can serve interrogatories on them to admit or deny something on Oath or to produce record or to produce applicable Govt Resolutions.

LR- 43 Today, Caption of a Virat Ship called Judiciary is changing, namely by judge named Justice JS Khehar.

Today, Caption of a Virat Ship called Judiciary is  changing,  namely by judge named Justice JS Khehar.

It makes a whole of difference to everyone on the ship and their families. His one wrong decision can sink the ship. His one right decision can move ship to better lands, better foods, better safety.

He has to protect us from pirates and typhoons at sea.

He is our Nakhuda(Next to God).

As I understand, he has lived on farms. He has toiled lands with his own hands. He he has seen tyrannical rules in South Africa until he was in seventh standard.

In eigthth standard, his family came to India. He is among those shikhs where "Pride and Self Respect still matters."

One subject nearest to his heart is to improve standards in Legal profession.

This subject alone, if he gives close attentions, will earn him blessings of silent majority of good Lawyers for many many years to come.

At present, true advocates, true ethical Advocates have no say in elected system of Bar Regulating bodies.

Fee standardisation rules for Junior Lawyers, legal aid allotment of cases to fresh  junior lady Lawyers , speedy procedures for removal of unethical Lawyers, website publishing names and code of all Lawyers of India, publishing list of Lawyers against whom actions are pending, pension funds for Lawyers are some the avenues requiring reform.

All Supreme Court Juddge stay for a few years in Supreme Court. Very few have agenda of reforming Bar.

Now, there are hopes. Let us keep our fingers crossed and pray to God.

LR-42 A common misunderstanding about legal paper usesd in HC and in SC.

In many high courts green legal size papers are used in filing in HC.

In SC only white legal size papers are used.

Frequently documents are sent by trial court or High Court Advocates on green legal size.

This should be sent on while legal size paper only, typed in double space on one side of paper with larger left margin for binding purpose.
